Terms of Use for ColorRush: Turf War

ColorRush: Turf War ("the app") is developed by Görkem Güclü ("we", "us"). By using the app you agree to these terms.

Relationship to Apple's terms

The app is distributed through the App Store and is licensed, not sold, to you under Apple's Licensed Application End User License Agreement. Those terms apply in full. The terms below add to them and explain how the app's own currency, purchases and subscription work.

What the app is

ColorRush is a game. You colour tiles on a shared board against another player or against the computer, under a time limit. There is no other purpose and no warranty that playing it will achieve anything beyond entertainment.

Diamonds

Diamonds are an in-app currency with no monetary value. They cannot be bought for money, cannot be exchanged for money, cannot be transferred to another person and cannot be redeemed outside the app.

You earn diamonds by:

  • playing matches, up to a daily limit
  • claiming the daily gift, once per day
  • watching a rewarded advertisement, which is always optional

Diamonds are stored on your device and mirrored to your own iCloud account so they survive a device change. They are not stored on a server of ours. If you delete the app and its iCloud data, your diamonds are gone and cannot be restored by us.

Color palettes

Palettes are cosmetic. They change the colours of the board and nothing else — no palette gives a player any advantage.

A palette can be unlocked in three ways:

  1. Permanently with diamonds. Once bought this way, it stays yours.
  2. Through a Deluxe subscription, for as long as the subscription is active.
  3. As a free trial, once per palette, for two hours. The trial costs nothing and can be used only once for any given palette.

Palettes unlocked through Deluxe become locked again when the subscription ends. Palettes bought with diamonds do not.

Deluxe subscription

Deluxe is an auto-renewing subscription available monthly or yearly. It unlocks every palette in the store, including palettes added later while the subscription is active.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage and cancel the subscription in your Apple Account settings at any time.
  • Current prices are shown in the app before purchase and vary by region.

Refunds are handled by Apple, not by us. Requests go through Apple's support page.

Advertising

The app shows rewarded advertisements, which you choose to watch in exchange for a diamond. You are never required to watch one to keep playing. Advertisements are delivered by Google AdMob and are configured as non-personalised. What data this involves is described in the Privacy Policy.

Online play

Online matches run through Apple's Game Center and require a Game Center account. Your Game Center display name and profile picture are visible to your opponent during a match. There is no chat function.

We do not guarantee that an opponent will be available, that a match will complete, or that a connection will hold. Matches can end when a player disconnects.

Fair use

You may not modify the app, tamper with its data, or use tools to obtain diamonds or unlock palettes other than through the ways described above. Doing so may cause the app to stop working correctly; we have no way to restore progress lost this way.

Availability and changes

The app is provided as it is. We may change, add or remove features, palettes and prices at any time. Content that has already been bought permanently with diamonds stays available to you.

Liability

To the extent permitted by law, our liability is limited to intent and gross negligence. Statutory liability for injury to life, body or health remains unaffected. Nothing in these terms limits rights you have as a consumer under mandatory law.

Applicable law

German law applies, without prejudice to mandatory consumer protection provisions of the country in which you have your habitual residence.
